Terms & Conditions
1. Eligibility & Driver Requirements
Renter must be at least 21 years of age, possess a valid driver's license, and provide current proof of insurance for the towing vehicle. Only the named Renter, or persons specifically authorized by A1A Trailer Rentals in writing, may tow or operate the trailer.
2. Tow Vehicle & Equipment Requirements
Renter is solely responsible for ensuring their towing vehicle is rated for the loaded weight of the trailer (GVWR) and is equipped with a properly rated hitch, ball, safety chains, electrical connection, and brake controller where applicable.
3. Condition & Pre-Rental Inspection
Renter acknowledges they have personally inspected the trailer at pickup, that it is in good working order, and that any pre-existing damage has been documented on the inspection checklist.
4. Permitted & Prohibited Use
The trailer may be used only for lawful purposes within the continental United States. Prohibited uses include off-road or racing use, hazardous materials, livestock or human passengers, subletting, or operation while impaired.
5. Insurance, Risk of Loss & Indemnification
Renter's personal auto liability and physical damage insurance is the primary coverage during the rental period. Renter agrees to indemnify and hold harmless A1A Trailer Rentals from all claims arising from Renter's use of the trailer.
6. Damage, Loss & Theft
Renter is responsible for the full cost of repair for any damage occurring during the rental period, regardless of fault. Theft or total loss requires payment of full fair-market replacement value plus loss-of-use damages.
7. Security Deposit
A refundable security deposit of $100 is collected at the start of the rental and returned within 7 business days after the trailer is returned in equivalent condition.
8. Returns, Late Fees & Cleaning
Late returns are subject to a fee of $25 per hour. Trailers returned uncleaned are subject to a $50 cleaning fee. Failure to return within 24 hours without approval may be reported to law enforcement.
9. Cancellation Policy
Cancellations more than 24 hours before start: full refund. Within 24 hours: $25 fee. No-shows forfeit the entire rental fee.
10. Mechanical Issues During Rental
A1A Trailer Rentals' sole liability for trailer failure through no fault of Renter is limited to a prorated refund for unused time and reasonable recovery assistance.
11. Assumption of Risk
Towing a trailer involves inherent risks. Renter acknowledges and voluntarily assumes these risks and waives claims against A1A Trailer Rentals for injury or damage arising from such inherent risks.
12. Governing Law & Venue
This Agreement is governed by the laws of the State of Florida. Disputes shall be brought in state or federal courts in St. Johns County, Florida.
13. Severability & Entire Agreement
If any provision is found unenforceable, the remaining provisions remain in full force and effect. This Agreement constitutes the entire agreement between the parties.
14. Acknowledgement
By signing, Renter confirms they have read and understood all terms, accept full responsibility for the trailer during the rental period, and have authority to bind themselves or any business entity.
